What is the status of the following narration in Bayhaqi?

Nabi (sallallahu ‘alayhi wa sallam) said:

“Sacrifice/slaughtering is three days after Yawmun Nahr (10th of Dhul Hijjah/The day of ‘Eidul Adha)”

 

Answer

Imam Bayhaqi (rahimahullah) has recorded this narration -as you have stated-, on the authority of Sayyiduna ‘Abdullah ibn ‘Abbas (radiyallahu ‘anhuma)

(As Sunan Al Kubra, vol. 9, pg. 296)

However ‘Allamah ‘Ala-udin Ibnut Turkumani (rahimahullah), a Hanafi Muhaddith has pointed out an extremely weak narrator in the chain. He then cites the following narration recorded by Imam Tahawi (rahimahullah) in Ahkamul Quran:

Sayyiduna ‘Abdullah ibn ‘Abbas (radiyallahu ‘anhuma) reports that Rasulullah (sallallahu ‘alayhi wa sallam) said:

“Sacrifice/slaughtering is two days after Yawmun Nahr (10th of Dhul Hijjah)”

Ibnut Turkumani (rahimahullah) has declared the chain of narrators for this Hadith as good (jayyid).

He further states that the Fuqaha (Jurists) are unanimous that slaughtering on the 13th of Dhul Hijjah is not permissible, with the exception of Imam Shafi’i (rahimahullah), who has permitted this.

Note 1: Imam Bayhaqi (rahimahullah) has recorded other narrations as well, which state that Qurbani is four days. However ‘Allamah Ibnut Turkumani (rahimahullah) has stated that non are authentically transmitted.

Note 2: This is a legitimate difference of opinion among the Fuqaha (Jurists) and therefore the above should not be viewed as a Fiqh ruling. I have merely answered your question, and provided the proofs that support the Hanafi view (as well as the majority of Jurists).
